WAIVER AND RELEASE OF LIABILITY

READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

In consideration of being allowed to participate in any way in the sports, recreation, and/or fitness activities (hereinafter each an “Activity” and collectively the “Activities”) at, DAS Cricket, DAS Cricket Academy, DAS Adventure Sports Inc., Stelton Sports LLC, NJ Blackcaps LLC, Atlanta Blackcaps LLC I, the undersigned, for myself and on behalf of my personal representatives, assigns, heirs, and next of kin, hereby agree to the following:

I understand the nature of the Activities and confirm that I am qualified, in good health, and in proper physical condition to participate. I understand that participation may involve risks of serious injury, including but not limited to permanent disability, paralysis, and death, as well as economic and social losses, which may result from my own actions or inactions, the actions or inactions of others, the condition of the premises or equipment, or the negligence of the “Releasees” named below.

I fully accept and assume all such risks and responsibilities for losses, costs, and damages I may incur as a result of participation.

I hereby release, discharge, and covenant not to sue DAS Cricket, DAS Cricket Academy, DAS Adventure Sports Inc., Stelton Sports LLC, NJ Blackcaps LLC, Atlanta Blackcaps LLC, its owners, administrators, directors, officers, members, agents, employees, volunteers, coaches, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Activities (collectively, “Releasees”), from all liability, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations.

I further agree to indemnify and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost they may incur as a result of such claims.

I agree to comply with all facility rules and safety instructions. I understand that failure to follow rules or staff direction may result in my removal from the premises without refund.

I authorize the Releasees to secure emergency medical treatment deemed necessary in the event I suffer injury or illness while participating. I understand that I am responsible for any related costs.

I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk of exposure by attending and participating in the Activities.

I grant Stelton Sports LLC and its designees, agents, and assigns the unlimited right to use, publish, and republish in any form or media, reproductions of my likeness or my child’s likeness (photographic or otherwise), with or without identification by name, for promotional or instructional purposes.

This agreement shall be governed by the laws of the State of New Jersey. Any legal action related to this waiver shall be filed in Middlesex County, NJ.

I, the parent and/or legal guardian of the minor participant named below, understand and acknowledge the risks described above and believe the minor to be qualified, in good health, and capable of participating in the Activities.

I hereby release and agree to indemnify and hold harmless the Releasees from all claims resulting from the minor’s participation, including any claims of negligence, to the fullest extent permitted by law.
